1. General terms and conditions of sale

1.1 General terms and conditions of sale are between consumer (further Customer) and SIA “Magistr” company, the founder of Internet store balticropes.com (further balticropes.com), to determine the purchasing and selling procedure and conditions and also in order to help to solve the questions involving the legal obligation of both parties.

1.2 Purchasing procedure in Internet store balticropes.com is determined by the 28th of May 2002 Cabinet of Ministers regulations No 207 “Regulations of distance contract” and also by the consumer rights protection Law of Latvian Republic.

1.3 The goods and the prices on display have an informative nature on the balticropes.com website. The item can be different from the picture. On the picture can be details, which are not included in the item’s packaging. The use of information of the website balticropes.com does not cause the legal obligations between the visitors and creators of the Internet store. Balticropes.com holds one-sided rights to change the general sale conditions and the offered products’ price policy at any time. Changes and additions to the pricelists and conditions to take effect from the moment of publication on the home page balticropes.com. The orders that are placed before the changes have taken effect; the conditions at the moment of the order are applicable.

1.4 Making an order and payment in the Internet store balticrope.com, the customer confirms to be aware of the general terms and conditions of sale and agrees them.

1.5 Purchasing and selling contract takes effect after the whole payment for the products only.

2. Balticropes.com pricing policy

2.1 On the Internet store balticropes.com the prices for the products are indicated in EUR (euro currency) without the transportation expenses and including value-added tax (VAT) 22%.

2.2 The transportation cost for the goods depends on the goods’ volume and to be discussed separately.

2.3 Balticropes.com reserves the rights to change the prices. If the customer places the order before the prices’ changes have taken effect; the price that is indicated on the order invoice at the registration moment is applicable.

3. Payment of the ordered products

3.1 Payment of the ordered products is made:

- by the transfer using the online banking on the given account

- by payment with the debit/credit card on the Internet store balticropes.com

- by payment with PayPal paying system on the user’s account given

4. Delivery and handing in of the products

4.1 If the item is in stock, the shipment of the item will be made within 24 hours (on the working days) to the customer, beginning from the moment of money receipt, using services of DPD or DHL delivery companies.

4.2 If the needed item is out of sock and it needs to be produced, the customer has to make a whole payment (100%) of the product’s value. The production term is up to 30 days. When the item is produced, its shipment to the customer will be processed within 24 hours (on the working days).

4.3 In the case of the shipment terms mismatch the information that is indicated in the product description or dispatched dates to the customer and it is clear that the delivery of the goods are not possible at the confirmed date because of the reason, which does not depend on balticropes.com, balticropes.com undertakes to inform the customer about the changes of the delivery time by the contact phone number +371 65447811 or e-mail info@balticropes.com within 3 days from the time when balticropes.com receives the relevant information.

4.4 The product is handed over to the customer on the basis of the relevant documents. Before the receiving and accepting the goods by signing all the relevant documents, we recommend you carefully examine packaging of the product. If the damage is detected, we advise you not accept the product. By signing all the relevant documents, the customer confirms that the packaging of the product is not damaged or in satisfying condition (product is not damaged) at the moment of receiving. If the packaging of the product is damaged (in the case of visible damage of the product under the packaging or there is doubt) we recommend you to return the item to the delivery person and to inform about the problem by e-mail info@balticropes.com or by the phone number +371 65447811.

5. Guarantee and returns

5.1 Balticropes.com are unable to accept returns of cut lengths, special custom orders including splicing work due to their custom made nature. Should you need to return any other item for any other reason, please contact balticropes.com by e-mail info@balticropes.com or by the phone number +371 65447811. The goods must be in an unused state with undamaged and original packaging and we should be notified within 14 days of your receipt of the goods. If there is a fault with the goods we shall undertake to repair or replace the item at our discretion. The repair/replaced item will be shipped back to you free of charge. The basis for the guarantee will be only the products supplied by the manufacturer. This guarantee is in addition to your statutory rights, which remain unaffected. Any contract will be governed by the Latvian Law.

5.2 Detecting the damage of the product the customer should do the following:

5.2.1 to find the bill (invoice) of the item purchase

5.2.2 to inform about the problem in application form, sending it by e-mail info@balticropes.com or calling to the customer service number +371 65447811. It is necessary to indicate invoice/order number in the application form. For the application form the clear pictures of the open product’s damage and the packaging is necessary to attach.

5.3 Balticropes.com does not take the responsibility if:

5.3.1 the damage of the product is the result of the customer fault;

5.3.2 the damage of the product is the result of the incorrect usage;

5.3.3 the product has a natural wear from the usage.

6. Responsibility of the parties and Force Majeure

6.1 Balticropes.com is responsible for non-observance of the general terms and conditions, evaluating each case in the procedure and the volume as it is stated in the Legislation of Latvian Republic.

6.2 The customer is responsible for non-observance of the general terms and conditions, evaluating each case in the procedure and the volume as it is stated in the Legislation of Latvian Republic.

6.3 The parties are not responsible for the non-observance or not proper observance of contractual obligations if this non-observance occurs in the result of insuperable force. The insuperable force is considered to be fire, natural disaster, epidemic, explosion or similar expressions of insuperable force that troubles parties to fulfill their obligations. Under these circumstances it is necessary to inform the second party as soon as possible.

7. Other conditions

7.1 The rights and responsibility of the Internet store balticropes.com with regard to individual person data processing and protection is governed by valid Legal Rights of Republic of Latvia, including Individual Person Data Protection Law. Balticropes.com uses the personal data for completion the customer’s order only. Balticropes.com withholds customer’s personal data that the customer has given for the order registration, and does not spread it to the third parties, except the cases that are specified by the Laws of the Latvian Republic.

7.2 Balticropes.com reserves the right to inform the customer about the new products, services and discount offers. The customer has the right to request the whole deletion from database of the balticropes.com website.

7.3 Arguments and disagreements related to the fulfillment of general terms and conditions of sale are solved by inter parties negotiations. In case of unsolved arguments and disagreements between balticropes.com and the customer, each party has the right to protect their rights in accordance with Latvian Republic Legislation.
